Terms of Service

1. Acceptance of Terms

By accessing or using the Impersona service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use the Service. We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

Impersona provides a software development kit (SDK) that enables developers to simulate user sessions during development and testing. The Service is designed exclusively for use in development environments and includes:

• An SDK for integrating user impersonation capabilities into development workflows
• A browser-based widget for switching between user contexts
• Configuration tools for defining user presets
• Team collaboration features for sharing presets
• Documentation and support resources

Important: Impersona is intended solely for development and testing purposes. The Service includes safeguards to prevent operation in production environments.

3. Account Registration & Security

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access to your account
• Accept responsibility for all activities under your account

You may not share your account credentials with third parties or allow multiple individuals to use a single account. Each team member must have their own seat.

4. Permitted Use

4.1 Authorized Uses

You may use the Service to:

• Test role-based access control (RBAC) implementations
• Verify permission configurations during development
• Debug user-specific functionality in development environments
• Demonstrate features to stakeholders in non-production settings

4.2 Prohibited Uses

You may NOT use the Service to:

• Impersonate users in production environments
• Access data you are not authorized to view
• Circumvent security controls or access restrictions
• Conduct activities that violate applicable laws or regulations
• Engage in any activity that could harm Impersona, its users, or third parties

5. Security & Token Handling

This section is critical to understanding the Service.

5.1 Development-Only Tokens

Impersona generates impersonation tokens that are valid only in development environments. These tokens:

• Contain environment-specific markers that prevent production use
• Are validated against environment detection before issuance
• Expire according to configurable timeframes
• Are never stored on Impersona servers after generation

5.2 Customer Responsibilities

You are responsible for:

• Ensuring the SDK is not deployed to production environments
• Securing your development environment against unauthorized access
• Configuring appropriate token expiration settings
• Maintaining audit logs if required by your compliance obligations

5.3 Credential Handling

Impersona does NOT store, transmit, or have access to actual user credentials. User presets are defined in your codebase and remain under your control. We only process the metadata necessary to generate session contexts.

5.4 Breach Notification

In the event of a security incident affecting the Service, we will notify affected customers within 72 hours of becoming aware of the incident, in accordance with applicable data protection regulations.

6. Intellectual Property

6.1 Our Rights

The Service, including its source code, documentation, design, and branding, is owned by Impersona and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

6.2 Your Rights

You retain all rights to your code, configurations, and data. We claim no ownership over your user presets, integration code, or any data processed through the Service.

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, royalty-free license to use such feedback without restriction.

7. Payment Terms

7.1 Pricing

Current pricing is available on our website. We may change pricing with 30 days' notice. Price changes do not affect existing prepaid periods.

7.2 Billing

Subscriptions are billed every six months in advance. Published seat prices are shown per seat per month for comparison, but each invoice covers the full six-month billing period. Bespoke development for Enterprise customers is negotiated as a separate standalone contract. All fees are non-refundable except as required by law.

7.3 Taxes

All prices are exclusive of applicable taxes. You are responsible for any VAT, sales tax, or similar taxes applicable to your purchase.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED
• WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

9. Indemnification

You agree to indemnify and hold harmless Impersona, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your deployment of the SDK contrary to the permitted use guidelines

10. Termination

10.1 By You

You may terminate your account at any time through the dashboard or by contacting support. Termination takes effect at the end of your current billing period.

10.2 By Us

We may suspend or terminate your access if you violate these Terms, engage in prohibited activities, or fail to pay applicable fees. We will provide reasonable notice except in cases of serious violations.

10.3 Effect of Termination

Upon termination, your license to use the Service ends immediately. Your user preset configurations remain in your codebase and under your control. We do not retain your data after account closure except as required by law.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or the Service shall be resolved in the courts of England and Wales.

For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence.
